The Limitations of Sheriff Sanders' Powers

                  I had a correspondence with Garland County Sheriff Larry Sanders recently and he said that the only way that he will be able to arrest Richard Gipe is if an Artist within the limits of Garland County has been victimized by one of his Art Scams. If you are a victim of one of this Grifter's Scams that resides within the limits of Garland County then contact me immediately so that we can finally bring this Monster to Justice.

Thank you. For too long Hot Springs Art has had a void in judgement and as a result the Art has suffered. It is my intention to fill that void. I didn't know that The Art Church was a real Gallery. I thought it was some kind of childrens Art Charity, but don't worry I will investigate. I want to learn more about you... in particular what Galleries besides Star Gallery are you affiliated with?

So true. We really should be held accountable for what we produce. As artists, we all just want to support one another, and we end up dishing out complements, not wanting to hurt any one's feelings. I'm glad you have the guts to be honest on your public website.
As far as galleries I've been affiliated with: My show is hanging at the ACAC in Little Rock on the corner of 6th and main streets. The mural Michael Shaeffer and I made is there as well. After June 1st I'll return to STAR unless another opportunity presents itself. I started showing at Muzu Muzu in 2005 or 6, also at The Local in 2009 and a show or two at Low Key arts. For the past two years I have compiled and published The Valley of the Vapors Zine. Paul Cooper and I are currently working on a series of drawings. And my team (Sarah Sanders, Paul Cooper, Brook Oleson, and Derek Taylor) and I have a huge project in the works at the Cultural Campus. I'll be heading a workshop making mini shrines with teens at camp Tanako this Summer. I design tattoo art by comission that is executed by my husband Trey Steelman (also an exceptional artist). Trey is showing in my stead at STAR until my show at the ACAC ends. There's more in the works, but these are my focus for the time being.

                              Also be sure to note the part where she said "I am just confused how art-exchange got into moca... We are on the up and up so our files are open and I would like for you to meet me and the "Real MOCA". I hope you will see how wonderful we are." When I called about an hour later Brook Ownbey answered and said that Lori was busy and asked for my name and number. When I said "Daniel Kimery" she immediately put me on the phone with her. During our 30 minute conversation she was crying her eyes out as if I were holding a gun to her head and she promised me full disclosure of their records while BEGGING ME to change my reviews of their so called Museum. Before I got off of the phone we made an appointment to meet in person the following wednesday. That night I did some research and came across these videos. The Next day when I confronted her about lying to me her tone was completely different. She had to have been coached by someone to go from being a spineless worm to being so bold over night. She said that she didn't understand what was going on, but she had talked to one of the Directors who's name remained anonymous (Richard Gipe) and he asked "So Daniel Kimery want's full disclosure like he's an F.B.I. Agent and all he is is just some random guy with a blog?". I then politely cancelled our appointment and told her that "As a reward for such insolence I will make it my Mission in Life to expose The MOCA Scam to the entire World and you will be listed as one of The Gate Keepers when I do. Maybe you will change your attitude when it's the F.B.I. looking through your files instead of me... and believe me they will after I've shown them everything that I've uncovered". She tried calling back several times after I hung up but I didn't answer and I haven't heard back from her or anyone else at MOCA since, but I'm pretty sure that they are all biting their nails and shitting their pants right now. The Moral to this story is to never underestimate the Power of a some random guy with a Blog.

In a letter e-mailed to his licensed gallery owners this week, the artist accused "disgruntled ex-dealers" and a former employee of launching "media attacks" on him. But he also said he might have behaved badly during a stressful time, now behind him, during which he overindulged in food and drink and gained 50 pounds.



"If during this period I ever offended anybody, I am sorry -- anyone who knows me knows I always try my best to be loving," he wrote in response to an article in The Times in which some ex-gallery owners and others painted a harsh portrait of the self-proclaimed "Painter of Light."
"The good news is I learned many valuable lessons from that phase of my life," Kinkade wrote. "With God's help and the support of my family and friends, I have returned balance to my life. And if you have seen me lately you know I have lost over 50 pounds and I feel terrific."
In sworn testimony and interviews with The Times, some ex-dealers have accused Kinkade -- whose dreamily inspirational limited-edition prints are steeped in Christian-oriented themes of faith and family values -- of ruining them financially while enriching himself and his business associates.
They and others also described incidents in which an allegedly drunken Kinkade heckled illusionists Siegfried and Roy; cursed a former employee's wife who came to his side when he fell off a barstool; fondled a startled woman's breasts at a signing party; and urinated on a Winnie the Pooh figure at the Disneyland Hotel in Anaheim.
In his letter, Kinkade said the alcohol-related accounts included "exaggerated, and in some cases outright fabricated personal accusations." He did not address any of the incidents specifically and has declined repeated interview requests.
"I've never had a problem admitting my own shortcomings and mistakes, but when people rewrite history or take events out of context to sling mud, that's downright wrong," he wrote.
The allegations emerge from arbitration claims filed by half a dozen former Thomas Kinkade Signature Gallery owners against the artist and Media Arts Group Inc., the public company he took private in 2004. Among other things, they allege they were stuck with expensive prints they couldn't sell and pressured to open new galleries in saturated markets.
They also accuse the artist of driving down the value of Morgan Hill, Calif.-based Media Arts Group before he bought it back for $32.7 million and renamed it Thomas Kinkade Co.

Why I am doing this.

                   I'm sure that a lot of the local yocals in Hot Springs probably think that I am Satan incarnate because I actually had the nerve to judge Artists, Agents, and Galleries as well as post Articles about all of The Art Scams in this town. See the problem with most of you people (and I use the term people very loosely here) in Hot Springs is that you've never really been anywhere else for any given length of time nor have you spoken to any Real Artists from outside the Hot Springs area so you don't know what the perception of your Art Community is to the outside world. That is why I am here to enlighten you. When Artist in other places all over the world hear the words "Hot Springs" the first things they think are Art Scam and Fading Scene that's been taken over by wannabe Artists that shouldn't be seen. World Class Artist from other places tell me this almost every time I mention Hot Springs. I remember a time back in the 90's(it seems almost a million years ago now) The Time of The Commercial Galleries when Hot Springs was an Art Mecca. Art Galleries were like Casinos with Wet Bars, Beautiful Women serving refreshments, and they were hustling the buyers by getting them drunk and excited. Then Richard Gipe came along with the Vanity Galleries and the scene went from Beautiful Women, Liquor, and Great Art to Little Old Ladies serving boxed wine in plastic cups, and the Art went to shit because they only promoted talentless hacks that are willing to pay to be seen. This started to happen around 2001. Then in recent years these so called Artists Collectives started popping up everywhere which are similar to Vanity Galleries in many ways. To me the the only difference between a Vanity Gallery and an Artists Collective is that Vanity Galleries cold call strangers from other places and Artists Collectives promote the work of their neerdowell cousins and sisters in laws. They both have the same result... bullshit Art that gets laughed at by Tourist. These Galleries have so badly infested this town that they make up like 3/4th's of the Art Industry here now. It is my mission to put a stop to this and return Hot Springs collectively(no pun intended) to the old ways of doing business and I will wreck every Gallery and every Person's reputation that stands in my way even if I haft to burn the entire Art Community down with my Reviews and Damning Articles. Like a Pheonix rising from the ashes a new and better scene will emerge. To put it quite simply I am trying to destroy the present Art Scene so I can resurrect the old one through it's sacrifice.

                  I talked to a photographer named Martin Spilker awhile back that was duped into buying exposure from them. He came by my house when he was in town and told me that he gave thousands of dollars to them but the good news was that somebody bought one of his prints for a hundred and fifty dollars. I then asked "Who bought it?". He said that he didn't know. Now if somebody liked your Art enough to by one of your pieces wouldn't they want to get in contact with you and wouldn't you want to get in contact with them in order to use them for future commissions? The truth is they take like $5,000.00 from an Artist to be seen in their Gallery and then they anonymously buy one of the pieces so The Artist feels good about theirself and the Company. They also do this so they can post on their blog (which is listed down below) that they have been selling the Art of many Artist. What they won't tell you is that they are only selling prints that they buy theirselves. Further evidence of this is the fact that every Artist in their Gallery sells at least one print. In real life Galleries don't work like this. There are winners and there are losers. Usually it is just one or two Artist that sell like Hot Cakes in a Gallery and nobody else sells anything. The fact that every Artist in their Gallery sells at least one print makes this whole thing smell very fishy even to somebody who isn't a former employee with inside information like myself. Will the lies never end? How many Artist will they be able to take advantage of before there is finally a reckoning for their crimes?

Why Gallerie 801's owner Steve Smith is no longer a City Councilman

Steve Smith  The citizens of district 3 have revolted.  In fact, Steve Smith can already be considered as "history."  For this reason, there is no real need to waste space in listing the multiple errors and misdeeds committed by this rude, crude, failed director. In district 4, Carroll Weatherford is not yet up for election.  However, a few signatures are still needed to have the sufficient number requiring his recall. Sign the petitions available outside the polls of district 4 during the election and this director will be removed from office shortly after the first of the year.  The reason the recall effort was suspended is that if the petitions were turned in now, the existing directors would be allowed to select Weatherford's replacement.  Be patient and sign the petitions. Expect to see a huge advertising blitz for Daniel.  Just remember that special interests have lots of money to spend.  We believe the candidates running against Daniel and Smith when they say they are running to represent the citizens and not special or personal interests.  Better days are ahead but we must first all get our friends and neighbors to the polls.

An appeals court has awarded $2.1 million to two gallery owners who say they were duped into selling Kinkade's schlock, then double-crossed by the Godly master himself in a scheme designed to let Kinkade buy out his own company at a low price:
In its February 2006 decision, the arbitration panel said Kinkade and other company officials used terms like "partner," "trust," "Christian" and "God" to create "a certain religious environment designed to instill a special relationship of trust" with the couple.
What the company didn't tell them, said their attorney, was that they would have to sell Kinkade's works at minimum retail prices while the artist undercut them with discount sales, some of which he made himself on cable television.
It was part of a plan, they claimed, to lower the value of the publicly traded company before Kinkade bought it in 2004, at steep losses to many investors.

Gallerie 801 does not have a Contract with Red Dot Miami

                    I just got off the phone with a representative at Red Dot Miami that said that Gallerie 801 had contacted them about having a Digital only presence and wanted to hand out CD's. He went on to state that they did not have a contract with them. If this is so then why are they trying to pitch an exhibition to Artist that they don't have booked and why are they selling wall space to Artists if they are only going to have a digital presence? This is text book Consumer Fraud and Trademark Infringement. The fact that this Gallery is owned by former City Councilman Steve Smith really scares the hell out of me. How does such an evil person get elected to the City Council? That's it. I'm moving out of Hot Springs. This town is way to crooked for me.

Gallerie 801's top exposure salesman Jalem Grome's criminal past revealed in The Portland Mail Tribune.

Police are seeking help to locate felon Jalem James Grome, who has a long criminal history with charges in four states.
Grome, 27, has a criminal histories in Oregon, California, New Mexico and Arkansas. He faces an outstanding felony warrant held by the Medford Police Department for second-degree burglary, second-degree theft, first-degree possession of a forged instrument and two counts of identity theft along with an outstanding warrant for probation violation on the original charges of identity theft, forgery and theft. Total bail is $50,000.
The Jackson County Sheriff's Department holds an additional felony warrant on the charge of probation violation, with a bail of $5,000.
Grome is described as a white male, 5 feet and 4 inches tall, weighing approximately 155 pounds with red hair and blue eyes. He has a "Joker" tattooed on his left forearm, the letter "J" tattooed in the web of his left hand and a star tattooed on the middle finger of his right hand. He also has pierced ears.                  In Honor of The Death of The Art Exchange I wanted all of you to see this link to Wet Canvas so you can all understand why I had the moral obligation to destroy The Art Exchange. Art-Exchange.com was an evil enterprise that prayed on Artists for over 17 years and I'm not ashamed to say that I balled my eyes out with joy and an overwhelming sense of pride and vindication when I read in The Sentinel Record that I had finally beaten them. Now before you go calling me a softy consider that I had been working nonstop for over a year and a half to rid the World of this Pseudo Art Agency and help over 2 dozen Artist get 63,500.00 dollars back. So that's one down and three to go. Now all I haft to do is wreck MOCA, Legacy, and Timothy's Fine Arts and I will be able to close this chapter of my life and move on to more pleasurable things than Revenge uhmm I mean Justice... If there is such a thing. I've almost forgotten about sex because this has been feeling so good. Artists are calling me "The Alex Jones of The Art World" and "The Julian Assange of The Art World". I'm not sure which title I like better but I am very flattered every time that I am referred to as either one.                        The Art by Chase Chan that you saw in this video was sold at a Garland County Circuit Court Auction May 18th 2011 along with The Art Exchange business in order to pay Richard Gipe's Creditor Diamond Bank. I thought MOCA was a Museum not an Art Gallery and I thought that the Art was supposed to be part of a PERMANENT COLLECTION so why is Richard selling Chase Chan's Art? Not to mention the fact that MOCA's Executive Director Lori Arnold lied to me today and said that they voted him off the Board a long time ago then went on to say that a nameless Director (Richard Gipe) asked and I quote "Why do we haft to prove anything to some random guy that has a blog?". This being after she was crying her eyes out on the phone yesterday begging me to change my review of their Gallery and promising me full disclosure of their records. The Fact that this hayseed of a woman is their Executive Director screams that all she is is a Mask for Richard Gipe to hide behind. Am I the only one that smells a rat here?

Daniel Damascus Kimery is attempting to display signed and unsigned prints of your art at any venue that will actually talk to him.  When he’s is rejected he launches a brutal terrorist verbal campaign against them.  He is very meticulous and knowledgeable about your profession and the inner workings of art galleries. He almost had me until I began asking for your legal information for contact and the contracts. At that point he accidentally gave me his real name which is different from the initial name he had given. When the red flag went up and I began to question him, it all went south from there. My concern is that if you are working with this young man you should be aware of his damming behavior and if you are not represented by this young man you should look into his actions regarding the use of your name.
I will be happy to assist you through your attorney if needed.

Dear Ms. Rawls;

Thanks for the info, although much of it does not agree with the information I have. Yes, Daniel Kimery (middle name Damascus) is representing me in a limited capacity which would cover your venue.

I see Daniel, while a bit high-strung and very passionate (and at times Hot-headed), as basically on the “Right” side of this Artist vs Gallery/rip-off divide which has gone on way too long in Hot Springs (and elsewhere) in the Art Community.

I was ripped off by Art-Exchange (more than once, due to my own stupidity) and Daniel is the ONLY one who has offered real assistance in getting my money back and JUSTICE. For this I am grateful to him.

As for the Contact Info or “contracts” you mentioned. My website, provided by Daniel or easily GOOGLED, has my phone number and, of course, I would welcome a call from a potential venue such as yours.

What was NOT mentioned is the “Hell hath no fury like a woman scorned” encounter between Daniel and your Poetry Mistress…FIVE or more years ago! And the phony claim of a Restraining Order. What is that dishonest crap about? And you immediately jump to support that without checking the veracity of the smear?

While my art could have put you on the map and generated (along with Daniel’s promotion skills) tons of traffic, I am coming to the conclusion that I do NOT want to do business with YOU.

At this point, Daniel and I, will continue to service a v large niche market and you can enjoy watching and supporting from the sidelines.

If he ever contacts you then just ask him if he has personally sold any Art and then hang up before he get's to respond because the answer is no. She also tried to convince me that they are just a Museum and that they don't sell any of the Art even though they just sold the Art of Chase Chan in a Court Auction to pay The Art Exchange's Creditor Diamond Bank while he was in their so called permanent collection of Art. When I asked about all the Artist on wetcanvas.com that were complaining about their Art being stolen by MOCA she said "Those Artist are lying". My visit with Lori Arnold reminded me of a line from Macbeth "Me thinks the Lady doth Protest too much". It's a pitty that she is Alison Parsons' sister. I hate to burn bridges with powerful people that I have no grievance against.
